INFORMATION CLAUSE

In connection with the recruitment process and as a consequence - establishing a cooperation based on an employment contract, civil law contract, B2B contract or contract of mandate between you and the company under the name DevsData LLC with headquarters in Brooklyn (NY11230) (further as: ‘Controller’) or Controller's client we hereby provide you with information about REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and the Law of 10th of May 2018 on the protection of personal data.

The controller processes your data to the extent necessary to fulfill this contract to which the data subject is a party or to take action at the request of the data subject before concluding the contract.

Your data is being processed for the purpose of conducting the recruitment process and concluding an employment contract, civil law contract, B2B contract or contract of mandate, with you by the Controller or the Controller's client and in connection with the provision of work or services by the Controller or the Controller's client.

Your personal data will be processed in the European Union, in Poland, and can also be processed in the United States and/or the United Kingdom which you agree with.

The controller is processing data such as:

• full name;
• home address;
• PESEL number;
• e-mail address;
• bank account number;
• employment history;
• your CV/resume;
• mailing address;
• photo;
• WhatsApp number;
• social media profiles including LinkedIn;
• your company’s details including TIN, name, and address;

All of the data being processed by the Controller has been given to us by you willingly directly to the Controller.

Your data will be processed for the duration of an employment contract, civil law contract, B2B contract or contract of mandate concluded between you and the Controller or the Controller's client, and after termination of the contract for the period required by law.

In connection with the processing of data for the purpose indicated above, the recipients of your personal data may be:

• public authorities and entities carrying out public tasks or acting on behalf of public authorities to the extent and for the purpose which result from the provisions of generally applicable law;
• entities cooperating with the Controller in the field of recruitment and body leasing service including the Clients of the Controller;
• other entities that, on the basis of the relevant agreements signed with the Controller, process personal data during the maintenance of the Controller’s IT system;

In regard to processing your data you have the following rights:

• right to access and receive the copy of your data,
• right to rectify your personal data when the data is incorrect or incomplete,
• right to erasure (‘a right to be forgotten’) when:
  • the data is not necessary anymore for the purpose it has been collected or otherwise processed,
  • the data subject has objected to the processing of personal data,
  • the data subject has withdrawn his consent to the processing of personal data and there is no other legal basis for the processing of the data,
  • personal data is processed unlawfully,
  • personal data must be deleted in order to comply with legal obligation,
• right to request restriction of the processing of personal data when:
  • the data subjects disputes/questions the accuracy of the personal data,
  • the processing of data is unlawful and the data subject objects to erasure of the data, requesting their restriction in return,
  • the Controller no longer needs the data for his or her purposes, but the data subject needs it for establishment, defense or redress,
  • the data subject has objected to processing of the data, until it is determined whether the legitimate grounds on the part of the Controller override the grounds for objection.

You have the right to withdraw your consent to the processing of your personal data. Consent may be sent at any time by means of communication indicated under the heading "Contact details". Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Your data may be processed in an automated way and cannot be profiled.

W związku z prowadzonym procesem rekrutacji oraz zawarciem w jego konsekwencji umowy o pracę, umowy zlecenia lub innej umowy cywilnoprawnej pomiędzy Panią/Panem, a spółką pod firmą DevsData LLC z siedzibą w Brooklyn, NY 11230, USA, (dalej: „Administrator”) lub klientem Administratora niniejszym przekazujemy Panu/Pani informacje o ROZPORZĄDZENIU (UE)2016/679 PARLAMENTU EUROPEJSKIEGO I RADY z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) oraz ustawy z dnia 10 maja 2018 w sprawie ochrony danych osobowych.

Administratorem danych osobowych jest DevsData LLC z siedzibą w 1820 Avenue M, Suite 481 Brooklyn, NY 11230, USA.

Administrator przetwarza Pani/Pana dane w zakresie niezbędnym do wykonania umowy, której stroną jest osoba, której dane dotyczą lub do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy.

Pańskie dane przetwarzane są w celu zawarcia z Panią/Panem przez Administratora lub klienta Administratora umowy o pracę, umowy zlecenia lub innej umowy cywilnoprawnej oraz w związku ze świadczeniem przez Panią/Panem pracy lub usług na rzecz Administratora lub klientów Administratora.

Pana/Pani dane osobowe będą przetwarzane na terenie Unii Europejskiej, w Polsce. Mogą być również przetwarzane w stanach zjednoczonych (USA) na co wyraża Pan/Pani zgodę.

Administrator przetwarza dane takie jak:

• imię i nazwisko
• data urodzenia
• miejsce zamieszkania
• adres mailowy
• nr. konta bankowego
• doświadczenie zawodowe
• wizerunek/zdjecie
• historia zatrudnienia
• dane adresowe
• numer telefonu
• profile social media

Wszystkie dane przetwarzane przez Administratora zostały przekazane przez Panią/Pana dobrowolnie bezpośrednio Administratorowi.

Pańskie dane będą przetwarzane przez okres obowiązywania pomiędzy Panią/Panem, a Administratorem lub klientem Administratora umowy o pracę, umowy zlecenia lub innej umowy cywilnoprawnej, a po rozwiązaniu umowy przez okres wymagany przepisami prawa.

W związku z przetwarzaniem danych w celu wskazanym powyżej odbiorcami Pani/Pana danych osobowych mogą być:

• organy władzy publicznej, administracji rządowej i samorządowej oraz ew. podmioty realizujące zadania publiczne lub działające na zlecenie władz publicznych lub samorządowych w zakresie i celu wynikającym z przepisów powszechnie obowiązującego prawa,
• podmioty współpracujące z Administratorem w zakresie rekrutacji i usług body leasingu;
• innym podmiotom, które na podstawie stosownych umów podpisanych z Administratorem przetwarzają dane osobowe w trakcie obsługi systemu informatycznego Administratora.

W związku z przetwarzaniem Pańskich danych osobowych przysługują Pani/Panu następujące prawa:

• prawo dostępu do swoich danych i otrzymania ich kopii,
• prawo do sprostowania danych osobowych, jeżeli dane są nieprawidłowe lub niekompletne,
• prawo do usunięcia („prawo do bycia zapomnianym”), gdy:
  • dane nie są już niezbędne do celu, w którym zostały zebrane lub w inny sposób przetwarzane,
  • osoba, której dane dotyczą, wniosła sprzeciw wobec przetwarzania danych osobowych, osoba, której dane dotyczą wycofała zgodę na przetwarzanie danych osobowych i nie ma innej podstawy prawnej przetwarzania danych,
  • dane osobowe są przetwarzane niezgodnie z prawem,
  • dane osobowe muszą zostać usunięte w celu wywiązania się z obowiązku prawnego,
• prawo do zażądania ograniczenia przetwarzania danych osobowych, gdy:
  • osoby, których dane dotyczą, kwestionują prawidłowość danych osobowych,
  • przetwarzanie danych jest niezgodne z prawem, a osoba, której dane dotyczą, sprzeciwia się usunięciu danych, żądając ich ograniczenia,
  • Administrator nie potrzebuje już danych do swoich celów, ale osoba, której dane dotyczą, potrzebuje ich do ustalenia, obrony lub dochodzenia roszczeń,
  • osoba, której dane dotyczą, wniosła sprzeciw wobec przetwarzania danych, do czasu ustalenia, czy ważne prawnie uzasadnione interesy administratora mają nadrzędny charakter wobec interesów lub podstawowych praw i wolności osoby, której dane dotyczą

Przysługuje Panu/Pani prawo do wycofania zgody na przetwarzanie danych osobowych. Oświadczenie w tym zakresie może być wysłane w każdym czasie za pomocą środków komunikacji wskazanych w polu ”Dane kontaktowe” powyżej. Wycofanie zgody nie ma wpływu na legalność przetwarzania danych osobowych mających miejsce w oparciu o udzieloną zgodę do czasu jej wycofania.

Pańskie dane mogą być przetwarzane w sposób zautomatyzowany i nie mogą być profilowane.
